Welcome to pixyit Inc. (“pixyit,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of our website, www.pixyit.com, including My Gallery, the public gallery, online shop, kiosks, and related digital services, collectively, the "Services".

 

By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use our Services.

1. Eligibility

 

pixyit is designed to celebrate kids' creativity and help families collect, share, and enjoy children's artwork.

 

You must be at least 13 years old to create an account or submit information directly through the Services. If you are under 18, you may use the Services only with permission from a parent or legal guardian.

Children under 13 may view publicly available content on pixyit, but they may not create accounts, submit personal information, upload artwork, make purchases, or share content publicly on their own. A parent or legal guardian may create and manage an account, upload artwork created by a child under 13, add artwork titles or stories, make purchases, and choose whether to share artwork publicly.

If you are using the Services on behalf of a child, or uploading artwork created by a child, you represent and warrant that you are the child's parent or legal guardian, or that you have received all necessary permission from the child's parent or legal guardian to upload, share, display, sell products featuring, or otherwise use the child's artwork and related content through pixyit.

 

By using the Services, you represent that you meet these eligibility requirements and that all information you provide is accurate and complete.

2. Account Registration

 

To use certain features of the Services, including My Gallery, artwork uploads, subscriptions, public sharing, personalization, and purchases, you may need to create an account.

If you are 13 or older but under 18, you may create or use an account only with permission from a parent or legal guardian. Your parent or legal guardian is responsible for your use of the Services, including any purchases, uploaded artwork, public sharing choices, and communications with pixyit.

You agree to provide accurate, current, and complete information when creating an account and to keep your account information up to date.

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Please notify us promptly if you believe your account has been accessed or used without authorization.

If you create or manage an account for the purpose of uploading a child's artwork, you are responsible for selecting what content is uploaded, choosing what content (if any) is shared publicly, and ensuring that you have the necessary rights and permissions to use the artwork and related content through the Services.

3. User Content: Uploading Kids’ Artwork

 

pixyit allows users to upload children's artwork, artwork stories, titles, descriptions, names, age information, and related content, collectively, "User Content".

You retain ownership of the artwork and User Content you upload.

By uploading User Content to pixyit, you represent and warrant that:

  • You own the content or have the necessary rights and permissions to upload it

  • If the artwork was created by a child, you are the parent or legal guardian, or you have permission from the parent or legal guardian

  • The content does not infringe on the rights of any third party

  • The content is appropriate for display and use through the Services

 

By uploading User Content, you grant pixyit a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, modify, adapt, and use the User Content as needed to provide the Services, including creating galleries, previews, products, order mockups, marketing materials, and customer support.

If you choose to make artwork public or submit it for public display, you authorize pixyit to display that artwork and related information in public-facing areas of the Services, including the public gallery, community pages, event pages, partner showcases, and promotional materials.

4. My Gallery and Public Gallery

 

My Gallery allows users to collect, organize, and preserve children's artwork and the stories behind each piece.

Some gallery content may remain private unless you choose to share it publicly or submit it to a public gallery, event, campaign, partner showcase, or other public-facing pixyit experience.

 

If you choose to share artwork publicly, you understand that other users, supporters, or visitors may be able to view the artwork, read the related story or description, and purchase items featuring the artwork where available.

 

You may request removal of your uploaded content by contacting us. Removal may not affect orders already placed, products already produced, or materials already reasonably in progress.

5. Partner Programs and Kiosks

 

pixyit works with a range of partners, including community organizations, educational institutions, venues, and brands, to bring pixyit experiences to kids in different settings. These may include interactive kiosks, events, activations, and other programs, collectively, "Partner Programs".

Artwork submitted through Partner Programs

When a child submits artwork through a pixyit kiosk or Partner Program, the same ownership and licensing terms in Section 3 apply. The parent or legal guardian of the child is responsible for ensuring that appropriate consent has been given for the artwork to be submitted and displayed through pixyit.

Partners are responsible for obtaining parental consent before collecting or submitting any artwork or participant information through pixyit on behalf of children.

Partner showcases

Artwork submitted through Partner Programs may be displayed in a partner showcase, public gallery, event display, or promotional materials, subject to the sharing settings and consent established at the time of submission.

Partner-specific terms

Specific Partner Programs may have additional terms or conditions, which will be disclosed at the point of participation. In the event of a conflict between those additional terms and these Terms of Use, the additional terms will govern for that specific program.

6. Intellectual Property & Usage Restrictions

 

User Artwork and Content

The rights to uploaded children's artwork remain with the applicable owner: the parent, guardian, or child, as applicable. Other users, visitors, and third parties may not copy, reproduce, sell, or use uploaded artwork without permission.

pixyit Designs and Product Mockups

pixyit may create product mockups, layouts, previews, edits, and designs using uploaded artwork. These designs are created to provide the Services and fulfill orders. You may not copy, reproduce, or resell pixyit-created product designs, templates, mockups, or layouts outside the Services without permission.

pixyit Content

All pixyit website content, branding, logos, design, text, graphics, software, and other materials are owned by pixyit Inc. or its licensors and may not be used without authorization.

7. Orders, Payments and Custom Products

Many pixyit products are custom-made or made to order. Product images, previews, and mockups are for reference and may vary slightly from the final product due to differences in production, materials, screen display, artwork quality, and placement.

By placing an order, you agree to provide accurate order information, including product selections, personalization details, shipping information, and uploaded artwork where applicable.

Payments are processed by third-party payment processors. pixyit does not store full payment card information.

8. Personalization and Design Previews

 

For certain personalized products, users may upload their own artwork and request a custom design.

Where offered, pixyit may send a design preview before the product is made. You are responsible for reviewing the preview carefully and responding within any stated timeframe.

 

If you approve a preview, or if you do not respond within the required timeframe where stated, pixyit may proceed with production.

 

We design with care, but final products may vary slightly from digital previews.

9. Refunds, Replacements, and Returns

 

Because many pixyit products are custom-made or made to order, we generally do not accept returns for buyer's remorse, preference changes, or incorrect information provided by the customer.

However, if you receive a defective or incorrect item, you may request a refund or replacement.

Refunds or replacements may be available if:

  • The product arrives damaged or defective

  • The product does not match the order details

  • The wrong item was shipped

  • There was an error caused by pixyit or one of our production partners

 

To request a refund or replacement:

To request a refund or replacement, contact us within 15 days of receiving your order at customer-care@pixyit.com and provide your order number, a clear photo of the item, and a description of the issue.

Depending on the situation, we may offer a replacement, partial refund, full refund, or another reasonable resolution at our discretion.

Exclusions

We do not offer refunds or replacements for:

  • Buyer's remorse or preference changes

  • Incorrect shipping information provided by the customer

  • Low-quality uploaded images that affect the final product

  • Artwork, spelling, names, titles, or personalization details submitted incorrectly by the customer

  • Minor variations in color, placement, sizing, or production that are normal for custom-made items

10. Kid Royalty and Nonprofit Giving

 

pixyit is committed to helping kids see the value of their creativity and giving back to the communities that support them.​​

Kid Royalty

For eligible orders featuring a child's artwork, pixyit allocates 3% of the order value toward a royalty balance tracked for that child. This is automatic and requires no enrollment.

When a child's royalty balance reaches $10, pixyit will contact the parent or guardian via the email address on file to arrange a payout. Payouts are currently processed manually and on a per-request basis. pixyit does not store payment account details. Any payment information shared during the payout process is used solely for that transaction and is not retained by pixyit.

Royalty balances are subject to pixyit's program rules and applicable laws. pixyit reserves the right to update, pause, or modify the royalty program at its discretion. Changes will be communicated to affected users where reasonably possible.

Giving Back

pixyit donates 5% of eligible orders to youth nonprofit organizations or nonprofit partners. The recipient organization may vary by campaign, partner program, or event, and will be disclosed where applicable.

Donation programs may be updated, paused, modified, or discontinued at pixyit's discretion.

11. Subscriptions and Gallery Plans

 

pixyit may offer free and paid gallery plans. Paid plans may renew on a recurring basis according to the plan selected at checkout.

By purchasing a paid plan, you authorize pixyit or its payment processor to charge the applicable fees at the stated billing interval unless you cancel according to the cancellation terms provided at purchase.

 

If you need to change plans, please contact us and we will help you switch without duplicate billing where possible.

 

pixyit may update plan features, pricing, storage limits, artwork limits, or other subscription details from time to time. Changes will apply as described at the time of update or renewal.

12. User Conduct & Account Suspension

 

You agree not to:

  • Upload or share abusive, harmful, offensive, illegal, or inappropriate content

  • Upload content that infringes on another person's intellectual property, privacy, publicity, or other rights

  • Use pixyit to harass, exploit, or harm children or other users

  • Engage in fraudulent, misleading, or unlawful behavior

  • Attempt to access another user's account or private gallery without permission

  • Interfere with the security or operation of the Services

 

If we determine that a user has violated these Terms, we may remove content, cancel orders, suspend access, or terminate the account without prior notice.

13. Third-Party Services

 

pixyit may use third-party services for hosting, payments, production, shipping, analytics, email communications, and other business operations.

Your use of certain features may also be subject to the terms and policies of those third-party providers.

 

pixyit is not responsible for third-party websites, services, policies, or practices that we do not control.

14. Disclaimer of Warranties

 

The Services are provided on an "as is" and "as available" basis.

pixyit does not guarantee that the Services will always be uninterrupted, secure, error-free, or available at all times.

 

We make reasonable efforts to provide accurate product information, pricing, and availability, but errors may occur. We reserve the right to correct errors, update information, or cancel orders affected by errors.

15. Limitation of Liability

 

To the fullest extent permitted by law, pixyit Inc. is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.

Our total liability for any claim related to a product or order is limited to the amount you paid for the product or service giving rise to the claim.

 

We are not liable for claims related to intellectual property infringement or other rights violations arising from User Content submitted by users.

16. Indemnification

 

You agree to indemnify and hold harmless pixyit Inc., its officers, employees, contractors, partners, service providers, and affiliates from any claims, damages, losses, liabilities, costs, or expenses arising from:

  • Your use of the Services

  • Your uploaded User Content

  • Your violation of these Terms

  • Your violation of any third-party rights

  • Any inaccurate information or unauthorized content you provide

17. Governing Law and Dispute Resolution

 

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

Any disputes arising from these Terms or the Services will be resolved in the state or federal courts located in Delaware, unless otherwise required by applicable law.

18. Changes to These Terms

 

We may update these Terms from time to time. If changes are significant, we may notify users by posting an update on our website, sending an email, or providing another notice through the Services.

The updated Terms will be effective as of the "Last Updated" date above. Continued use of the Services after updates means you accept the revised Terms.
